1. SF-DCT RELEASES CLAIMS CRITERIA INFORMATION FOR 3 DISEASES AND CONDITIONS IN THE PLAN: PRIMARY SJOGREN’S SYNDROME (PSS), MIXED CONNECTIVE TISSUE DISEASE (MCTD) AND OVERLAP SYNDROME (OS)

Pursuant to an "Agreed Order Resetting Final Disease Cure Deadlines" entered by the Court on June 15, 2007, the SF-DCT will release claims criteria information for three eligible diseases in the Plan: Primary Sjogren’s Syndrome (PSS), Mixed Connective Tissue Disease (MCTD) and Overlap Syndrome (OS) on November 1, 2007. Copies of all three documents are available on the CAC website (www.tortcomm.org) under the heading "Disease Claims" or on the SF-DCT website (www.sfdct.com). Claimants who applied for one of these diseases but received a deficiency notice about that claim will be sent a letter from the SF-DCT regarding a final cure deadline of May 1, 2008.

The next scheduled release of information will be on December 3, 2007 concerning Systemic Lupus Erythamtosus (SLE) and Systemic Scleroderma (SS). Information on General Connective Tissue Symptoms (GCTS), Atypical Neurological Disease Syndrome (ANDS) and Atypical Connective Tissue Disease (ACTD) will be released on January 3, 2008. We are also working with the SF-DCT about release of general disease and disability guideline information and hope to have that available soon.


2. FINANCE COMMITTEE RELEASES UPDATED MEMORANDUM REGARDING THE SECOND QUARTER 2007 REPORT FROM THE INDEPENDENT ASSESSOR

The Finance Committee recently posted a Memorandum from the Independent Assessor regarding the second quarter of 2007 on its website. A copy of the Memorandum is also available on the CAC website (www.tortcomm.org). The Memorandum states in part that:

"The Independent Assessor of the Settlement Facility - Dow Corning Trust (SF-DCT) reviewed the liabilities and assets of the facility as of the end of the second quarter of 2007 and estimated that the facility would remain solvent under each of a range of liability and asset assumptions tested. Until patterns of filing and claims acceptance become more certain, use of the current estimates for the purpose of determining whether premium payments can be made is premature."


3. STATUS OF NOI SETTLEMENT

The Settlement Facility mailed information about the NOI settlement to all eligible NOI claimants or their attorneys on October 19, 2007. Only those claimants who are eligible for the settlement will receive the package of information.

If you receive the NOI package, please read it carefully and, if you are represented by an attorney, consult with him or her about the settlement. If you want to accept the settlement, you need to complete the “NOI Acceptance Form” that is enclosed in the package (you can also download a copy of the form on the CAC website under “NOI/Rule 3005 Issues.) If you still have your bar coded labels with your name and address on them, you can use these labels on the form. If you do not have your labels, go ahead and write your name and address on the form. You do not need your labels to complete and return the form but you do need to fill in the information box so the Settlement Facility can identify and locate your claim. While you can call the Settlement Facility’s toll free number (866-874-6099) to get labels mailed to you, this is not necessary. The sooner you return the Acceptance Form, the sooner your claim will be placed in line for a review for Explant and/or Rupture (when or if you have already filed those claim forms).


4. REVISED OTHER PRODUCTS CONSENT ORDER (CLASS 9 and 10)

The Court conducted a hearing on the proposed Other Products Consent Order on October 18, 2007. After hearing comments from three claimants, the court took the matter under advisement. A slightly revised Consent Order was tendered to the Court that addressed the comments from the three claimants and overruled all objections to the Consent Order.

We will keep you posted on when the Additional Payments will be made to eligible Other Products claimants.


5. SETTLEMENT FACILITY PAYMENTS TO CLAIMANTS THROUGH SEPTEMBER 30, 2007 TOTAL $917,465,415

Through September 30, 2007, the Settlement Facility has approved and paid almost 100,000 claims totalling $917,465,415. Of this, approximately $898 million has been paid to Dow Corning breast implant claimants.

Proof of Manufacture Reviews for Classes 5, 6.1 and 6.2

Through September 30, 2007, the Settlement Facility has received 75,033 Proof of Manufacturer claim forms in Classes 5, 6.1 and 6.2 (Dow Corning breast implants claimants). Of the 75,033 claims, 60,881 or 81% have acceptable proof of a Dow Corning breast implant. Of the 60,881 Dow Corning claimants, over one-third or 20,391 women have been approved for a Rupture claim for their silicone gel breast implant.

Note: The approval percentages for Disease Options 1 and 2 include those claims that were previously approved by the MDL 926 Claims Office and are Opass through O in the Settlement Facility (i.e., the claimant had an implant from Bristol, Baxter or 3M and a breast implant from Dow Corning and has applied to receive 50% of her disease award in the Dow Corning case). As a result, the percentage of approved Disease claims processed by the Settlement Facility if actually lower.

Class 7 -Silicone Gel Material Claims

Approximately 11,000 claimants have been approved for either an Expedited Release Payment or a Disease Cash-Out Offer. Total payments to date from the Class 7 Fund are $15.5 million. The total fund is $57.5 million NPV. The Settlement Facility continues to review Proof of Manufacturer claims in Class 7 and expects to complete all Proof of Manufacturer reviews within the next year. As Proof of Manufacturer claims are approved, the Settlement Facility will send either the Expedited Release Payment of $600 U.S. to claimants who selected this option or a Disease Cash-Out Offer of $3,000 U.S. to claimants who selected the disease review.

7. DEADLINE REMINDERS!

Please mark your calendar with the claim submission deadlines. Please note that most of these deadlines mean that your claim forms and materials must be received by the SF-DCT by the posted deadline. Please mail all forms early enough so that they are received by the deadline listed below. If your claim form is not received by the deadline listed below, you will not be permitted to file a claim later.
