Recently, the MDL 926 Claims Office solicited comments to proposed Q&A's on Fixed Benefit Claims (Option 1 in the Dow Corning Settlement Option). The Revised Settlement Program (RSP) was approved by MDL 926 Judge Sam Pointer on December 22, 1995. The RSP is a "claims-made" settlement program that was offered to certain U.S. breast implant recipients with at least one implant from Bristol, Baxter or 3M (or, under certain conditions, a post 8/84 McGhan implant). Dow Corning did not participate in the Revised Settlement Program because it had filed for bankruptcy protection in May 1995.

The MDL 926 Claims Office in Houston, Texas is responsible for implementing the RSP and processing claims for Bristol, Baxter, 3M and McGhan. Notice of the RSP and claim forms for that settlement program were mailed in January 1996, and claims in the RSP have been and are still currently being processed and paid. It is important to note that registration in the MDL settlement is not the same as registration of a Proof of Claim form in the Dow Corning bankruptcy case. Claimants must have registered for each settlement separately.

The following deadlines and benefits are still currently available in the RSP for claimants who have an eligible implant from either Bristol, Baxter or 3M:

Late Registration - claimants who did not file a Timely claim in the RSP may still register with the MDL 926 Claims Office. Late Registrants will be paid benefits only pursuant to the Long Term Disease Schedule to the extent funds are available pursuant to the funding obligations of Bristol, Baxter and 3M.

Post 8/84 McGhan Claimants - are eligible to apply only for Long Term Disease. No explant or rupture claims will be paid.
