1. SETTLEMENT FACILITY PAYMENTS TO CLAIMANTS THROUGH DECEMBER 31, 2007 TOTAL $947,753,196

Through December 31, 2007 – 3½ years after the Dow Corning Plan’s “Effective Date,” the Settlement Facility has approved and paid almost 100,000 claims totalling $947,753,196. Of this, approximately $927.15 million has been paid to Class 5 and 6 Dow Corning breast implant claimants, $16 million has been paid to Class 7 Silicone Material Claimants and Foreign Gel Claimants, and $4.6 million has been paid to Class 9 and 10 Covered Other Product claimants.

Proof of Manufacture Reviews for Classes 5, 6.1 and 6.2

Through DECEMBER 31, 2007, the SF-DCT has received 75,071 Proof of Manufacturer claim forms in Classes 5, 6.1 and 6.2 (Dow Corning Breast Implant Claims). Of this number, 61,204 or 81.5% have acceptable proof of at least one Dow Corning breast implant. Of the 61,204 Dow Corning breast implant claimants with acceptable proof of manufacturer, almost 34% (one-third) or 20,643 women have been approved for a Rupture claim for their Dow Corning silicone gel breast implant.

Class 7 – Silicone Gel Material Claims

Approximately 11,848 claimants in Class 7 – Silicone Gel Material Claims – have been approved for either an Expedited Release Payment ($600) or a Disease Cash-Out Offer ($3,000). Total payments to date from the Class 7 Fund are $16 million. The total fund is $57.5 million NPV. The Settlement Facility continues to review Proof of Manufacturer claims in Class 7 and expects to complete all Proof of Manufacturer reviews within the next year. We are doing everything we can to urge the Settlement Facility to expedite the Class 7 Proof of Manufacturer reviews. As Proof of Manufacturer (POM) claims are approved, the Settlement Facility will send either the Class 7 Expedited Release Payment to eligible claimants who selected this option or a Disease Cash-Out Offer to claimants who selected the disease review. There are approximately 10,363 Proof of Manufacturer files pending review, and 872 Disease claims pending review, mostly in Disease Option 1. At this time, the SF-DCT is not processing Class 7 Disease claims and likely will not process any disease claims until the POM reviews are complete.

There are a number of pending appeals before the Claims Administrator and Appeals Judge regarding the marshaling requirement for certain Class 7 claimants. No decision has been made on these appeals. We will update you on this as soon as the information is available.

Update on Payment of Additional and Premium Payments to Claimants in Classes 9 and 10

On December 12, 2007, the District Court entered an order approving payment of Additional and Premium Payments to claimants who have an approved Medical Condition claim in Class 9 or 10 – the Dow Corning Covered Other Products Fund. The deadline to file an appeal to the Court’s Order has now passed, and payments will be issued within the next 1-2 weeks. The proposed payment chart is set forth below:

Payment Amounts Listed are for Class 9. For claimants in Classes 10.1 and 10.2, the Claims Administrator will apply the formula set forth in Schedule III to Annex A of the Claims Resolution Procedures (i.e., 10.1 payments will be 60% of the amount listed below, and 10.2 payments will be 35% of the amount listed below)

Class 9 and 10 claimants who received an Expedited Release Payment are not eligible for the Additional and Premium Payments.

Premium Payments for Class 5 and 6 (Dow Corning Breast Implant Claimants)

Premium Payments for claimants in Classes 5 and 6 are not approved at this time. We do not know when they will be approved by the Finance Committee and District Court. Section 7.03(a) of the Settlement Facility Agreement provides that the Finance Committee initiates the process for paying Premium Payments by filing a recommendation and motion with the District Court requesting authorization. To assist the Finance Committee, the Plan provides that an “Independent Assessor” shall be appointed to oversee and make recommendations concerning the development of projected funding requirements and the assessment of the availability or adequacy of assets. The Finance Committee’s recommendation and motion must be accompanied by a detailed accounting of the status of claim payments and distributions under both the Settlement and Litigation Facilities. Thereafter, the parties (Debtor’s Representatives and CAC) have an opportunity to be heard on the matter. Section 7.03(a) further provides that before Premium Payments may be allowed, the court must determine that all Allowed and allowable First Priority Claims and all Allowed and allowable Litigation Payments have been paid or that adequate provision has been made to assure such payment (along with administrative costs) based on the available assets.

At this time, neither the Independent Assessor nor the Finance Committee has made any decisions regarding the payment of Premium Payments.


2. UPDATE ON PROCESSING AND PAYMENT OF NOI CLAIMS (“Notice of Intent” or “Conditional” Claimants)

On September 7, 2007, the District Court approved a Consent Order that allowed Notice of Intent (NOI) or Conditional claimants to be eligible for Explant and Rupture benefits. Previously, Dow Corning had objected to payment of Explant and Rupture claims for this group of claimants (NOI claimants have always been eligible for Disease payments). NOI claimants do not have to return the NOI Acceptance Form because all NOI claimants are now deemed to be Settling NOI Claimants.

Approximately 10,549 NOI claimants were mailed a package regarding the NOI settlement and the new deadline that applies to NOI claims. Of this, 759 packages were returned as undeliverable because the claimant had moved and did not provide a forwarding address to the Settlement Facility. It is very important that you update your address and new contact information with the Settlement Facility. If you think you may be an NOI claimant and did not receive a package, call the Settlement Facility’s toll free number (877-874-6099) to receive a package. The deadline for NOI claimants to file a claim for benefits is October 20, 2008.

There are approximately 4,700 NOI claimants in Class 5 and 6 (Dow Corning breast implant claimants). Of this number, over 2,000 NOI claimants have not submitted a Proof of Manufacturer Form. It is very important to return the Proof of Manufacturer Form to the Settlement Facility ASAP. The sooner you submit the Proof of Manufacturer Form, the sooner your claim can be reviewed to determine if you are eligible for compensation. Do not wait until the last minute to submit your claim forms. This will cause a backlog and delay processing and payment of claims.

There are approximately 1,100 Rupture and 970 Explant claims filed by NOI claimants pending review in Classes 5 and 6. Processing of these claims should be completed within the next 120 days. Explant claims will be paid in full -- $5,000 (Class 5), and Rupture claims will be paid in installments (the first payment will be $10,000) until all NOI claims are processed.

IMPORTANT! If you are an NOI claimant, then you have additional time to have your Dow Corning breast implant removed to document and submit and a Rupture claim. The deadline for NOI claimants to submit an Explant and/or Rupture claim is October 20, 2008. If you need financial assistance to have the implants removed, contact the Settlement Facility and ask about the Explant Assistance Program. Remember, the extension of the Rupture deadline applies only to NOI claimants. It does not apply to timely filed claimants.


3. SF-DCT MAILS CLAIM FORM PACKAGES TO THE LATE CLAIMANTS IDENTIFIED IN THE COURT’S ORDER OF DECEMBER 12, 2007

On January 18, 2008, the Settlement Facility mailed claim form packages to those Late Claimants identified in the Court’s Order of December 12, 2007. Only those Late Claimants listed in the Order are eligible to participate in the Dow Corning Plan as a Late Claimant. No new late claims will be accepted by the parties.

If you are a late claimant, please note that you have a different deadline to apply for benefits. Not all deadlines in the Plan and claim form booklets apply to Late Claimants. Here are the deadlines for Late Claimants:

Class 5 and 6 Late Claimants. If you have at least one Dow Corning breast implant, then you must submit your Late Claim Class 5/6 Election Form and any and all claim forms for benefits with supporting documents so that they are postmarked on or before January 21, 2009. We urge you to submit your Proof of Manufacturer Form (the blue edged form) as soon as possible so that the Settlement Facility can review your claim to determine if you are in the correct class and if your proof is acceptable. You can only recover compensation in Class 5 or 6 if you have acceptable proof of a Dow Corning breast implant.

Class 7 Late Claimants. If you do not have any Dow Corning breast implants but have or had a silicone gel breast implant from either Baxter (Heyer-Schulte), Bristol (Natural Y, Surgitek, Meme, etc.), Bioplasty, Cox-Uphoff (CUI) and/or Mentor that was implanted between 1976 and 1991, then you must submit your Late Claim Class 7 Election Form and claim form with supporting documents so that they are postmarked on or before July 21, 2008.

Class 9 and 10 Late Claimants. If you have a Covered Other Product claimant (a Dow Corning implant other than a breast implant as defined in the Plan), then you must submit your Class 9/10 claim forms and supporting documents so that they are postmarked on or before July 21, 2008.

Please pay attention to your deadline. If you do not submit your claim forms and supporting documents by your deadline, then your Late Claim will be permanently dismissed and you will not receive any compensation.


4. SF-DCT RELEASES AN UPDATED LIST OF APPROVED AFFIRMATIVE STATEMENTS REGARDING EXCLUSIVE USE OF DOW CORNING BREAST IMPLANTS AS OF DECEMBER 26, 2007

On December 26, 2007, the SF-DCT released an updated list of doctors whose statement about their exclusive use of Dow Corning breast implants are being accepted by the SF-DCT. If you submit medical records that show you had implant surgery performed by one of the physicians on this list during the time frame listed, you may submit these documents to the SF-DCT for consideration and approval.

The SF-DCT reports that this list may continue to change in the future as Class 7 claims are reviewed and conflicting information about a doctor’s exclusive use of Dow Corning breast implants is noted.

5. THE NEXT RELEASE OF CLAIMS CRITERIA AND INFORMATION BY THE SETTLEMENT FACILITY WILL BE ON FEBRUARY 18, 2008

We are working with the Settlement Facility on the next release of information about claims processing and criteria on February 18, 2008. The information will be on Scleroderma claims. We aer also working to provide additional information on ACTD claims.


6. DEADLINE REMINDERS!

Please mark your calendar with the following claim submission deadlines. Note that different deadlines apply to Notice of Intent (NOI) Claimants and Late Claimants. Please note that most of these deadlines mean that your claim forms and materials must be received by the SF-DCT by the posted deadline. Please mail all forms early enough so that they are received by the deadline listed below. If your claim form is not received by the deadline listed below, you will not be permitted to file a claim later.

April 2, 2008 Cure Deadline for certain claimants who previously filed a claim for Polymyositis or Dermatomyositis (consult the SFDCT about your specific cure deadline)
May 1, 2008 Cure Deadline for certain claimants who previously filed a claim for Primary Sjogren’s Syndrome (PSS), Mixed Connective Tissue Disease (MCTD) or Overlap Syndrome (OS) (consult the SF-DCT about your specific cure deadline)
July 21, 2008 LATE CLAIM DEADLINE FOR CLASS 7, THE SILICONE MATERIAL CLAIMANT FUND and LATE CLAIM DEADLINE FOR CLASSES 9 AND 10, COVERED OTHER PRODUCTS FUND. This deadline only applies to Class 7, 9 and 10 Late Claimants listed in the Court’s Order of December 12, 2007.
August 18, 2008 Cure Deadline for certain claimants who previously filed a claim for Systemic Sclerosis / Scleroderma (consult the SF-DCT about your specific cure deadline)
October 1, 2008 Cure Deadline for certain claimants who previously filed a claim for General Connective Tissue Symptoms (consult the SF-DCT about your specific cure deadline)
October 20, 2008 NOI CLAIMANTS’ Deadline to submit Explant and/or Rupture claims – Classes 5, 6.1 and 6.2 (this deadline only applies to NOI claimants; it does NOT apply to timely filed claimants)
November 1, 2008 Cure Deadline for certain claimants who previously filed a claim for Atypical Neurological Disease Syndrome (ANDS) (consult the SF-DCT about your specific cure deadline)
December 15, 2008 Cure Deadline for certain claimants who previously filed a claim for Systemic Lupus Erythematosus (SLE) (consult the SF-DCT about your specific cure deadline)
January 21, 2009 FILING DEADLINE for LATE CLAIMANTS in CLASS 5 AND 6 to submit all claim forms and supporting documents. This deadline only applies to LATE CLAIMANTS in Class 5 and 6.
February 2, 2009 Cure Deadline for certain claimants who previously filed a claim for Atypical Connective Tissue Disease (ACTD) (consult the SF-DCT about your specific cure deadline)
June 2, 2014 Explant Claims submission deadline for timely filed claimants in Classes 5, 6.1 and 6.2 (NOTE: this deadline does NOT apply to NOI claimants or Late Claimants)
June 3, 2019 Disease or Expedited Release Claim submission deadline for all claims in Classes 5, 6.1 and 6.2 (this deadline does NOT apply to Late Claimants)
